Terms & Conditions

1. Introduction

These Terms and Conditions govern the use of the WaveTickets platform (https://www.wavetickets.net/) (“the Platform”), operated by Wavesoft (Pty) Ltd.

By accessing or using the Platform, you agree to be bound by these Terms and Conditions and Privacy Policy.

2. Definitions

  • "Platform" refers to the WaveTickets website and system.
  • "Customer" refers to any person purchasing a ticket.
  • "Event Organiser" refers to any person or entity listing events on the Platform.
  • "Services" refers to ticketing, event listing, and related services provided by WaveTickets.
  • "Personal Information" has the meaning assigned under the Protection of Personal Information Act, 2013 (POPIA).

3. Role of WaveTickets

  • WaveTickets provides a platform that enables Event Organisers to list events and sell tickets.
  • WaveTickets acts as an intermediary facilitating transactions between Customers and Event Organisers.
  • WaveTickets is not responsible for the organisation, execution, or quality of events.

4. Customer Purchases

  • All ticket purchases are subject to availability and successful payment.
  • Upon successful payment, Customers will receive an electronic ticket.
  • Customers are responsible for reviewing event details before completing a purchase.
  • Tickets may not be resold or transferred unless explicitly permitted.

5. Event Organiser Responsibilities

  • Event Organisers are solely responsible for the planning and execution of their events.
  • Organisers must ensure all event information is accurate and up to date.
  • Organisers must honour all valid tickets sold via the Platform.
  • Organisers are responsible for complying with all applicable laws and regulations.

6. Payments and Organiser Payouts

  • Payments for ticket purchases are processed securely via third-party payment providers.
  • All ticket sale proceeds are received by WaveTickets and recorded against the relevant event.
  • WaveTickets will settle proceeds to Event Organisers after the event has taken place, in accordance with agreed terms, less applicable fees.
  • WaveTickets reserves the right to withhold or delay payouts in cases of suspected fraud, disputes, or breaches of these Terms.

7. Refunds and Cancellations

  • Refunds are subject to the Event Organiser's stated refund policy.
  • In the event of cancellation, Customers may be eligible for a refund depending on the circumstances.
  • WaveTickets may assist in facilitating refunds but does not assume liability for refund obligations.
  • Refund requests must be made within the applicable timeframes communicated at the time of purchase.

8. Chargebacks and Payment Disputes

  • A chargeback occurs when a Customer disputes a transaction with their bank, resulting in a reversal of funds.
  • Event Organisers accept full responsibility for all transactions related to their events, including chargebacks and payment disputes.
  • WaveTickets may withhold, delay, or offset payouts where chargebacks or disputes are suspected.
  • Where funds have already been paid to an organiser, any chargeback amount shall be recoverable and immediately payable to WaveTickets or deducted from future payouts.
  • Event Organisers agree to cooperate fully in providing evidence required to dispute chargebacks.
  • WaveTickets reserves the right to suspend or terminate organiser accounts in cases of excessive disputes or fraudulent activity.

9. Dispute Handling

  • Customers should first contact the Event Organiser regarding event-related issues.
  • WaveTickets may assist in resolving disputes at its discretion.
  • WaveTickets may suspend payouts pending the resolution of disputes.

10. Limitation of Liability

  • WaveTickets shall not be held liable for event cancellations, changes, or any losses incurred by Customers.
  • Responsibility for the event rests solely with the Event Organiser.
  • WaveTickets shall not be liable for indirect or consequential losses.

11. Account Suspension or Termination

WaveTickets reserves the right to suspend or terminate user accounts where:

  • There is a breach of these Terms
  • Fraudulent or suspicious activity is detected
  • Required information is not provided

12. Collection of Personal Information

WaveTickets collects and processes Personal Information necessary to provide its services, including but not limited to:

  • Name and surname
  • Email address
  • Contact number
  • Payment-related information (processed via secure third-party providers)
  • Event participation details

13. Purpose of Processing

Personal Information is collected and used for the following purposes:

  • Processing ticket purchases and issuing tickets
  • Facilitating event participation
  • Communicating with Customers and Event Organisers
  • Providing customer support
  • Complying with legal and regulatory obligations

14. Legal Basis for Processing

WaveTickets processes Personal Information in accordance with POPIA based on:

  • Consent of the data subject
  • Performance of a contract
  • Compliance with legal obligations
  • Legitimate business interests

15. Sharing of Information

  • Personal Information may be shared with Event Organisers for the purpose of event management.
  • Payment information is processed securely by third-party payment providers (e.g., Payfast).
  • WaveTickets does not sell Personal Information to third parties.

16. Data Security

  • WaveTickets implements appropriate technical and organisational measures to protect Personal Information.
  • Secure encryption and access controls are used to prevent unauthorised access.

17. Data Retention

  • Personal Information is retained only for as long as necessary to fulfil the purposes outlined in this policy or as required by law.

18. Data Subject Rights

In terms of POPIA, users have the right to:

  • Access their Personal Information
  • Request correction or deletion of their information
  • Object to processing
  • Lodge a complaint with the Information Regulator of South Africa

19. Cookies and Tracking

  • The Platform may use cookies and similar technologies to enhance user experience and analyse usage.
